Terms of Service
Article 1 – Definitions
In these Terms & Conditions the following terms shall mean:

Cooling-off period: the period during which the consumer may exercise the right of withdrawal.

Consumer: the natural person who is not acting in the exercise of a trade, business or profession and who enters into a distance contract with the trader.

Day: calendar day.

Distance contract: a contract concluded between the trader and the consumer under an organised distance sales system without simultaneous physical presence, using one or more means of distance communication.

Durable medium: any instrument which enables the consumer or the trader to store information addressed personally to them in a way that makes future reference possible.

Right of withdrawal: the consumer’s right to withdraw from the distance contract within the cooling-off period.

Trader: Monami London, the company offering products and/or services to consumers at a distance.

General Terms & Conditions: these Terms & Conditions of Monami London.
Article 2 – Applicability

These Terms & Conditions apply to every offer of Monami London and to every distance contract concluded between Monami London and the consumer.

Before the contract is concluded, the text of these Terms & Conditions shall be made available to the consumer. If this is not reasonably possible, Monami London shall indicate how the Terms & Conditions can be accessed electronically or sent free of charge upon request.

In the event of additional product or service-specific conditions, the consumer may always rely on the most favourable applicable provision.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

Situations not covered by these Terms & Conditions shall be interpreted “in the spirit” of these Terms & Conditions.
Article 3 – The Offer

If an offer is subject to a limited period of validity or is made subject to conditions, this will be expressly stated.

The offer is non-binding. Monami London reserves the right to adjust or withdraw offers.

The offer contains a full and accurate description of the products and/or services offered. Images used are intended as a true representation of the products. However, slight differences in colour or appearance may occur.

Each offer clearly states the rights and obligations that arise upon acceptance, including:
-
the total price (excluding possible import VAT or customs clearance fees, which remain the consumer’s responsibility);
-
any delivery costs;
-
the method of conclusion of the contract;
-
the payment and delivery arrangements;
-
the applicability of the right of withdrawal;
-
the period for accepting the offer.

Article 4 – The Contract

The contract is concluded when the consumer accepts the offer and fulfils the conditions.

If the consumer accepts electronically, Monami London shall confirm receipt without delay.
-
Monami London takes technical and organisational measures to secure the electronic transmission of data and ensures a secure web environment.
-
Monami London may, within the law, obtain information on whether the consumer can meet their payment obligations. If Monami London has grounds not to conclude the contract, it is entitled to refuse or attach special conditions.

Monami London shall provide the following information upon delivery:
-
the registered office address for complaints;
-
details about the right of withdrawal or its exclusion;
-
warranty and after-sales service information.

Article 5 – Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days of receipt of the product, without giving any reason.
-
During the cooling-off period, the consumer shall handle the product and packaging with care. The product may only be inspected as would reasonably be allowed in a physical store.
-
To exercise the right of withdrawal, the consumer must notify Monami London in writing (email). The consumer must then return the product within 14 days. Proof of return (e.g. tracking) is required.
-
If the consumer fails to notify within 14 days or does not return the product in time, the purchase becomes binding.
Article 6 – Costs in Case of Withdrawal

Return shipping costs are the responsibility of the consumer.

Monami London will refund the purchase price within 14 days of receiving the return, provided the item is received back in original condition.
Article 7 – Exclusions of Withdrawal
The right of withdrawal does not apply to:
-
Products made to the consumer’s specifications or personalised.
-
Hygiene-sensitive products (e.g. underwear, cosmetics) once opened.
-
Perishable goods.
-
Digital content once download/access has started with the consumer’s consent.
Article 8 – Price

Prices will not be increased during the period of validity of the offer, except for VAT/tax changes.
-
All prices are exclusive of potential import VAT or customs charges, which may be collected by the courier at delivery.
-
Obvious errors or misprints do not bind Monami London.
Article 9 – Conformity & Warranty

Monami London guarantees that products comply with the contract, specifications, and reasonable standards of usability.
-
Any warranty provided by manufacturers does not affect statutory rights.
-
Defects must be reported within 14 days of delivery. Returns must be in original packaging.
-
Warranty does not apply if:
-
the consumer has repaired or modified the product;
-
the product was improperly used or exposed to abnormal conditions;
-
damage was caused by external circumstances outside Monami London’s control.

Article 10 – Delivery & Execution

Monami London will exercise the utmost care in fulfilling orders.
-
Delivery is to the address provided by the consumer.
-
Orders will normally be processed within 30 days. If delivery is delayed, the consumer will be informed within this period. The consumer may cancel the contract in case of excessive delay.

Risk of damage or loss passes to the consumer once delivered.
Article 11 – Subscriptions / Duration Contracts

Contracts of indefinite duration can be terminated by the consumer at any time with a maximum one-month notice period.
-
Contracts for a fixed period will end automatically unless expressly renewed.
Article 12 – Payment

Unless otherwise agreed, payments must be made immediately upon order confirmation.

Consumers must ensure that payment details are accurate.
-
In case of non-payment, Monami London reserves the right to charge reasonable collection costs.
Article 13 – Complaints

Complaints must be submitted in writing within 7 days of discovery of the issue.
-
Complaints will be answered within 14 days. If more time is required, Monami London will inform the consumer.
-
A valid complaint may lead to repair, replacement, or refund at Monami London’s discretion.
Article 14 – Governing Law
Contracts between Monami London and consumers are governed exclusively by UK law.
